Abstract

This article analyzes the participation of victims in parole hearings, within the tension between their right to effective protection and the convict’s due process guarantees. It examines national and provincial regulations, as well as inter-American standards and judicial practice in Jujuy. It argues that victim participation should aim to ensure security and dignity without undermining the rehabilitative purpose of punishment. Practical criteria are proposed to balance both rights in sentence enforcement hearings.
