Abstract

The procedural rules established by the jurisdictional units of the federal political system have shifted from the so-called mixed system—comprised of an initial inquisitorial stage followed by a plenary stage characterized by a moderated adversarial approach, with active judicial intervention—to a moderate adversarial system, ultimately reaching a pure adversarial system. This article examines these changes, which are not merely a modification of the criminal litigation system, but constitute a cultural paradigm shift with significant social impact challenges.
